Terms of Service & Platform Agreement

1. Agreement To Terms

By creating an account, browsing content, purchasing subscriptions, unlocking media, posting content, sending messages, or otherwise using FansStack, you confirm that you have read, understood, and agreed to these Terms. If you do not agree, you must not use the platform.

We may update these Terms from time to time. When we do, we will revise the effective date above or otherwise notify users where required. Your continued use of the platform after an update becomes effective means you accept the updated version.

2. Account Registration & Security

You may need to create an account to use certain features. You agree to provide accurate, current, and complete information when registering and to keep that information updated. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

We may require identity verification, age verification, creator verification, or other checks before allowing access to certain features. You agree to cooperate with reasonable verification requests and to not use false, misleading, or stolen information.

3. Eligibility & Compliance

FansStack may restrict access to users in certain jurisdictions, may require additional compliance steps for creators, and may deny or suspend access where necessary to comply with law, payment processor requirements, platform safety standards, or internal risk controls.

You agree not to use the platform if doing so would violate any law, regulation, sanction, or contractual obligation that applies to you.

4. Creator Responsibilities

If you are a creator, you are responsible for the content you upload, the accuracy of your profile information, your compliance with all applicable laws, and your compliance with all platform rules governing content, monetization, disclosures, and conduct.

You represent that you have all rights and permissions necessary to upload and monetize your content, including any required releases, licenses, age or identity documentation, and consent from any person who appears in the material where required by law or policy.

5. Fan Responsibilities

If you are a fan or purchaser, you agree to pay all applicable fees, use purchased content only as permitted, and comply with any restrictions on copying, redistribution, or commercial use. You may not use the platform to harass, threaten, impersonate, defraud, or exploit other users.

You are also responsible for ensuring that your use of the platform is lawful in your jurisdiction, including any restrictions on access to adult content, payment, or digital subscriptions.

6. Payments, Billing & Chargebacks

All payments are processed through third-party payment providers. By making a purchase, you authorize the applicable processor to charge your chosen payment method for the amount shown, including recurring charges where applicable and disclosed.

Subscription fees, tips, unlock fees, and promotional purchases may be subject to taxes, processor fees, or other charges depending on your location and the product purchased.

• Recurring billing may continue until cancelled in accordance with the product terms.
• Refunds, if any, are handled according to the applicable policy or required law.
• Unauthorized or abusive chargebacks may result in account restrictions or termination.
• We may retain relevant billing records to administer disputes, fraud prevention, and compliance obligations.

7. Digital Content Access

When you purchase or unlock content, you receive a limited right to access that content as described in the relevant product terms, creator terms, or content agreement. Unless otherwise stated, purchases do not transfer ownership of the content or any associated intellectual property rights.

Access to content may be temporary, account-based, or subject to the creator’s terms, subscription status, or platform availability. We may remove or restrict access to content where required by law, policy, safety concerns, or rights enforcement.

8. Prohibited Conduct

You may not use FansStack to do any of the following:

• Upload, share, request, or distribute illegal content.
• Post non-consensual, exploitative, harassing, abusive, or fraudulent material.
• Use stolen identity information, fake payment methods, or deceptive accounts.
• Circumvent access controls, security controls, rate limits, or content restrictions.
• Copy, record, leak, scrape, resell, or redistribute content in violation of creator or platform terms.
• Use the platform for spam, phishing, malware, scams, or other harmful activity.
• Interfere with the platform’s operation, moderation systems, or security measures.

9. Content Ownership & License

Creators retain ownership of their original content unless a separate written agreement states otherwise. By uploading content, creators grant FansStack a license to host, display, distribute, transmit, store, process, and moderate that content as needed to operate the service and enforce platform policies.

Users may not reproduce, distribute, modify, publicly display, or create derivative works from content except as expressly allowed by the creator or by the platform’s features and policies.

10. Moderation & Enforcement

FansStack may review, restrict, remove, label, demote, or block content and accounts at our discretion where necessary to enforce these Terms, protect users, comply with law, preserve platform integrity, or address abuse. We may act before or after content is published.

We may suspend or terminate accounts, limit features, withhold payouts where permitted, or require corrective action if we believe a violation has occurred or a user presents a risk to the platform or others.

11. Reporting & Appeals

Users may report content, accounts, or behavior that may violate these Terms or our policies. We may investigate reports and take action based on the seriousness of the issue, available evidence, and applicable law.

Where a review or appeal process is available, we may allow users to request reconsideration of certain enforcement decisions. Some actions may be final if they involve serious safety issues, repeated violations, or legal requirements.

12. Privacy & Communications

Your use of the platform is also governed by our Privacy Policy and Cookie & Tracking Technologies Policy. By using FansStack, you acknowledge that we may send you service notices, security notices, transactional messages, and policy updates.

You may also receive communications related to account activity, purchases, creator interactions, moderation issues, or support requests. You agree that these messages may be sent electronically.

13. Third-Party Services

FansStack may rely on third-party service providers for payment processing, hosting, analytics, support, identity verification, age verification, fraud prevention, and other operational functions. Those services may be subject to their own terms and privacy practices.

We are not responsible for third-party websites or services that are linked from the platform, and you use those services at your own risk.

14. FansStack Intellectual Property

FansStack, including our name, branding, logos, interfaces, software, design elements, and platform content, may be protected by intellectual property laws. Except for the limited rights expressly granted to you, no rights are transferred by your use of the platform.

You may not use our trademarks, branding, or copyrighted materials without permission, except where allowed by law or by written authorization from FansStack.

15. Disclaimers

The platform is provided on an “as is” and “as available” basis to the fullest extent permitted by law. We do not guarantee uninterrupted access, error-free performance, or that all content will always remain available.

We do not guarantee the accuracy, quality, legality, or reliability of user-generated content, creator content, or third-party services, and you use those materials at your own discretion.

16. Limitation Of Liability

To the fullest extent permitted by law, FansStack will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the platform, except where liability cannot lawfully be excluded.

17. Indemnification

You agree to indemnify and hold harmless FansStack, its affiliates, officers, directors, employees, and service providers from claims, damages, liabilities, losses, and expenses arising from your use of the platform, your content, your violation of these Terms, or your violation of any law or third-party rights.

18. Termination

We may suspend or terminate your account or access to the platform at any time, with or without notice, if we believe you have violated these Terms, created risk, or caused harm to the platform, other users, or third parties.

You may stop using the platform at any time. Certain provisions of these Terms will continue after termination, including provisions relating to intellectual property, payment obligations, indemnification, dispute resolution, and limitations of liability.

19. Governing Law & Disputes

To the extent permitted by law, these Terms and any dispute arising from your use of FansStack will be governed and interpreted according to the laws applicable to the company’s operating jurisdiction, without regard to conflict of law rules, unless a different rule is required by local law.

Additional dispute procedures, arbitration requirements, or venue rules may apply if stated separately in a related policy, purchase term, or legal notice.

20. Changes To These Terms

We may update these Terms at any time to reflect product changes, legal developments, security practices, or business needs. If changes are material, we may provide additional notice where required.

Continued use of FansStack after updated Terms take effect means you accept the changes.
